Enforcement
Having a patent, copyright, trademark, or trade secret is important, but no guarantee that others will respect those rights. Competitors may not understand the scope and nature of intellectual property rights or may simply disagree on their value or scope. Enforcement becomes necessary when an infringer refuses to respect those rights. However, litigation can be quite costly, and so starting an enforcement action requires close consultation with an attorney.
At CoSud Intellectural Property Solutions, we explore all alternatives to litigation with our clients, but if litigation is necessary, consider litigation management to be an important service to our clients. To avoid an "in-house" bias toward continuing a litigation, we often partner with an outside litigation firm, managing and directing their activities, "outsourcing" the basic litigation tasks to provide better cost control. Since most cases do settle before trial, it is important to control costs, and early in the case, explore terms for settlement.
